NEW JERSEY SLEEP SOCIETY LICENSING UPDATE – 11/15/03 

My name is Rita Brooks; I am hoping that you find the information I am about to give you helpful. I have been very involved in legislative and regulatory issues in New Jersey and am here today representing the Association of Polysomnographic Technologists’ Legislative Action Committee.  I appreciate the opportunity to participate in this meeting and to speak on behalf of the APT. 

I want to speak to you about legislative and regulatory issues in New Jersey and the importance of getting involved with issues that have impact upon the PSG profession.  As many of you are aware, there have been respiratory licensure issues throughout the United States that would limit polysomnographic technologists, technicians and trainees from performing their jobs.  In New Jersey, all sleep technologists without respiratory care credentials were sent regulatory cease and desist orders effective April 30, 2006.  This order means that certain procedures, such as CPAP and oxygen titration, and monitoring of some other physiological parameters (which was only recently put into the New Jersey respiratory therapists’ scope of practice) will only be permitted for those who have a respiratory care license by the effective date. 

This year, legislation was introduced by Senators Singer and Lesniak, which would provide that the practice of polysomnography would not be considered the practice of respiratory care, thus providing an exemption for from the Respiratory Care Practitioner Licensing Act.  Specifically, this legislation would not limit PSG professionals from performing their integral role in the diagnosis and treatment of sleep and waking disorders as long as they are under the general supervision of physicians licensed in the state.  This legislation is expected to be re-introduced in early 2004 by Senators Singer and Lesniak, and reviewed by the Senate Health, Human Services and Senior Citizens Committee.  Presently, the members of that committee include Senators Vitale, Singer, Allen, Buono, Kean and Rice. Representative Gusciora has also agreed to be the General Assembly sponsor.

Sleep Medicine cannot afford contentment and complacency. Your assistance is needed to ensure that this legislation is enacted in order to preserve our profession in New Jersey. There is already a healthcare workforce shortage, and removing qualified sleep technologists from labs in New Jersey will only complicate the equation and restrict access to patient care by reducing the number of sleep studies that could be performed. Professionals willing to work with APT to assure patient access to sleep studies and to preserve the autonomy of our distinct profession through advocacy and education are needed. 

In addition, being the first state to enact a drowsy driving law, New Jersey cannot afford to have drivers with potential sleep disorders driving on its roadways.

Here’s what you need to do: first, find out if any of the previously mentioned Senators represent the legislative district where you reside and/or work.  If you do not know your district, you can email the APT at aptaction@aptweb.org and we will help you find it. I have passed out sign up sheets that you may fill out if you would like APT to send you more information. Those of you who live and work in New Jersey, especially in certain districts, are needed to write a letter to your Senator in support of this legislation or a thank you letter to the bill sponsors, Senators Singer and Lesniak.  The APT and other national sleep organizations will be helping New Jersey with this important grassroots effort and will supply a sample letter with all the particulars about the bill that you can use.  However, it’s important to make this letter your own by including an example of how this legislation would benefit your patients. 

The APT is working cooperatively with various state respiratory care organizations to move toward acceptable conditions for our members regarding legislative and regulatory issues, as well as with the national organization for respiratory care.  The APT is also working on a legislative task force with related sleep organizations, including the American Association of Sleep Medicine, which represents clinicians who diagnose and treat sleep disorders and the Board of Polysomnographic Technologists, which develops, maintains and administers the credentialing exam.  This task force has developed joint documents and is working together on state legislative and regulatory initiatives.  In addition, APT’s Government Affairs Specialist is working with members and organizations to get positive legislation enacted for the PSG profession and to respond to regulatory actions when needed. 

APT invites you to become educated and involved in advocating for your profession or for your practice so that you may educate others on the standards that exist for the PSG profession by visiting the APT web site at www.aptweb.org.  There are a number of important position statements regarding the profession that are available on CD, which I will distribute at the end of this presentation.  You may also download these documents from the APT website www.aptweb.org   The CD also has a copy of the actual cease and desist order on it for your reference. 

Statements on the CD or the web include the three job classifications for PSG professionals – technologist, technician and trainee.  The classifications are nationally standardized and outline job requirements and the competencies and proficiencies that all sleep labs should be documenting for their employees.  Also available are statements on exemption and model exemption language, polysomnography as a distinct profession and core competencies.  In addition, the APT has recently released a curriculum outline that was part of a two-year project, which can be downloaded from the web site.

Finally, I encourage you to access this and additional information on the APT web site.  You can also sign up for the APT Political Advocacy Contact Team, or PACT, on the APT web site so that you may be kept up-to-date on important issues through APT communications channels and state/regional PACT coordinators.  Joining PACT will ensure that you will be contacted when a call to action is needed on critical state or national issues that affect your patients, the public and the PSG profession.  APT members can opt to be notified about important issues by emailing the APT Legislative Action Committee at the following address: aptaction@aptweb.org.  An effective grassroots network is essential to legislative success.

NJAST MEETING MINUTES

June 29, 2002

An informational meeting for all New Jersey sleep technicians was held on Sunday, June 29th at Capital Health System’s MERCER campus, 446 Bellevue Avenue, Trenton, NJ.  

The proposal that was put forth for polysomnography licensing in New Jersey was discussed.   Rita Brooks reviewed the events that had occurred since the previous meeting, including the proposed polysomnography licensing legislation that was tabled at the Commerce Committee meeting. 

Mike Lahey distributed copies of the NJAST by-laws for NJAST that formalize our organization.   Membership applications were distributed and $20 in dues was collected from all those who formally joined NJAST at the meeting. 

There was a call for nominations for officers and committee members.  Nominations should be forwarded to Tish Galloway tgalloway@che.org who has volunteered to coordinate nominations.

An update meeting is planned for October.
